GENERAL TERMS AND CONDITIONS Cake 5 Exclusive Cakes / CakeBABS
Dutch law applies to every order you place with Cake 5 Exclusive Cakes / CakeBABS and to everything you purchase from us (for example, workshops you attend). All offers and quotations are non-binding, unless otherwise stated. Cake 5 Exclusive Cakes / CakeBABS is not bound by its offer if there are printing, typographical, or programming errors in the mailings, quotation, or on the website. Cake 5 Exclusive Cakes / CakeBABS is not bound by a quotation or offer if the quotation and/or offer is based on an incorrect calculation. The product range offered on the website is subject to change. All images, dimensions, colors, weights, etc. of the products offered on the website or in quotations are approximate only and cannot give rise to compensation or cancellation. Orders and Payments Orders must be placed at least two weeks in advance, by email or telephone. Orders via WhatsApp are only accepted after confirmation from Cake 5 Exclusive Cakes / CakeBABS. Changes can be made up to two weeks before the agreed delivery date. Cake 5 Exclusive Cakes / CakeBABS reserves the right to refuse orders without giving reasons or to impose conditions, such as requiring a prepayment. Payments must be made no later than 7 days prior to delivery. Payment can be made via bank transfer, debit card, or cash upon pickup. No deposit required. After approval of the wedding cake design is received, the bride and groom will receive an invoice approximately two weeks before the wedding, with the request to pay BEFORE the wedding and/or ceremony. Order Pickup: Orders can also be picked up. The customer can pick up the order at Cake 5 Exclusive Cakes / CakeBABS, located at Kraaivenstraat 36-02, 5048 AB Tilburg, at an agreed-upon time. If the order is not picked up, no refund will be given. The customer is responsible for checking the order upon pickup. If there is an error in the order, the customer must report this immediately. We will then offer a solution where possible. The customer is also responsible for arranging transport. After receipt, Cake 5 Exclusive Cakes / CakeBABS is not responsible for the HACCP standards that apply to the transport of refrigerated food products. On-Site Delivery: Cake 5 Exclusive Cakes / CakeBABS will deliver the ordered products on-site if the customer has fulfilled all payment obligations prior to the delivery date. The customer must ensure sufficient refrigeration space at the delivery address. For delivery to the specified location, we must be available from 9:00 AM on the day of delivery. The customer should allow for some time variability, both before and after the agreed-upon delivery time, as we have multiple deliveries on a single route. HACCP: We work exclusively with fresh ingredients and quality products to ensure the best final product. All orders are carefully prepared in accordance with HACCP guidelines. If you have any allergies, please be aware that our bakery handles gluten and nuts daily. We do our utmost to prevent cross-contamination. However, we cannot and cannot offer any guarantees. Traces of gluten and nuts may be present. Transport and delivery costs: Delivery costs depend on distance and time and are included in the quote. This amount is specified directly with the order quote. Naturally, we ensure that the order is delivered safely. Should anything unexpectedly go wrong with the order during delivery, we will do our utmost to rectify the situation or find an alternative solution. Transfer of risk and ownership: The risk for the delivered goods passes from Cake 5 Exclusive Cakes / CakeBABS to the customer as soon as delivery has taken place or has been received upon pickup. Presentation and cutting of the wedding cake: Cake 5 Exclusive Cakes / CakeBABS will deliver the wedding cake on the agreed-upon day and time to the agreed-upon location, where we will place the product(s) in the refrigerator. We do not present the wedding cake ourselves; that is the responsibility of the venue's party manager. Cutting the cake is also handled by the venue's staff, who are professionally qualified in cutting wedding cakes. If it's a new location, we will provide the staff there with instructions on how to cut the cake. We will only take care of this if we have clearly agreed in advance with the bride and groom that we are able to cut the wedding cake ourselves. Flowers on the wedding cake: The bride and groom do not need to order flowers from their florist and therefore do not need to pay for additional flowers. Cake 5 Exclusive Cakes / CakeBABS arranges the flowers themselves, which is included in the price of the cake. We will contact the wedding venue and florist IN the week of the wedding to discuss all the details. Liability and allergies: Cake 5 Exclusive Cakes / CakeBABS makes every effort to take allergens, such as gluten and nuts, into account (if requested) when preparing its products. However, it cannot be ruled out that traces of allergens may be found in the pastry products. Cake 5 Exclusive Cakes / CakeBABS is not liable for any damage caused by the use of its products by persons with allergies or intolerances. When placing an order, the customer is required to indicate any allergies or intolerances. Cake 5 Exclusive Cakes / CakeBABS will do its utmost to accommodate these. Cake 5 Exclusive Cakes / CakeBABS uses edible inks. These will approximate the colors of the printed and screen images, but a 100% match is impossible. This also applies to the fondant colors. The sketch design is a proposal and an impression of the final result. Cake 5 Exclusive Cakes / CakeBABS reserves the right to deviate from this if this is important for the final result. Adjustments regarding the design, taste preferences, or the size of the (wedding) cake can be made up to two weeks before the wedding. Booking & Cancelling Your Ceremony and/or Order: A ceremony is definitively booked once CakeBABS has received written confirmation. This can be done via email or through our customer system. In the event of cancellation of an order or ceremony, no costs will be charged if it is cancelled at least two weeks before the delivery date. Payments for ceremonies and orders must be made in advance. Within 7 days of receiving the invoice. Always before the delivery date/wedding day. Illness or Force Majeure: Should we be unable to prepare and/or deliver your order due to illness or force majeure, we reserve the right to cancel your order at any time. If possible, we can see if a colleague baker can take over the order. We will, of course, do our utmost to ensure your order goes ahead. If we take over an order from a colleague baker for you, please note that this is subject to our terms and conditions and prices. In the event of illness of the CakeBABS, a replacement will be provided so that the ceremony can proceed. This will be performed by a professional substitute legally authorized to perform weddings. Intellectual Property Rights: All intellectual property rights relating to Cake 5 Exclusive Cakes / CakeBABS products, including images, trademarks, and copyrights, belong to Cake 5 Exclusive Cakes / CakeBABS. No information, texts, logos, trademarks, trade names, or images obtained through the website or social media platforms may be copied, forwarded, distributed, reproduced, or published without prior (written) permission from Cake 5 Exclusive Cakes / CakeBABS.
